Wanted: Environmental Liability Assumption Projects.

If you or your clients have contaminated properties or projects for which one or more parties are looking to transfer environmental liability to a third party, we have a New Jersey-based client who may be willing to assume the liability.

General acceptance criteria:

  • New Jersey real estate — commercial/industrial sites in the northern/central portion of the State are preferred;

  • Sites that have completed the Remedial Investigation (RI) phase, and are at, or in, the Remedial Action (RA) phase are preferred;

  • Certain sites in, or slated for, Direct Oversight (DO) by the New Jersey Department of Environmental Protection (NJDEP) will be considered;

  • Certain perfluoroalkyl substance (PFAS)-contaminated sites will be considered; and

  • Remuneration can take the form of strict realty transfer, monetary transfer, or a hybrid of both.

No fees to inquiring parties.  Non-disclosure agreements will be executed, if/as required; release/indemnity options to be negotiated; insurance-backed liability transfer performance guarantees available.

Interested parties with one or more target parcels are encouraged to contact Glenn Brukardt at glenn.eikon@gmail.com. Our client's counsel will manage the potential transfer process beyond the initial inquiries stage.
